Terms of Service

1. Agreement to Terms

Powskill ("we", "us", "our") operates the online study platform at powskill.com for International Baccalaureate (IB) students. By creating an account, accessing, or using Powskill, you agree to be bound by these Terms of Service, our Privacy Policy, and our End User License Agreement (EULA). If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use Powskill. If you are between 13 and 18, you confirm that a parent or guardian has reviewed these terms and consented to your use of the service. By creating an account, you represent that the information you provide is accurate and complete.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at support@powskill.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms, remain inactive for an extended period, or are reasonably suspected of fraudulent activity.

4. Subscription Plans and Payments

Powskill offers the following tiers: Free, Starter, Standard, and Unlimited. Paid plans are available with the following billing cycles: monthly, 3-month, 6-month, annual, and 2-year.

• Payments are processed through PayPal. We do not store your credit or debit card details.
• By subscribing to a paid plan, you authorize recurring charges at the beginning of each billing cycle until you cancel.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
• We verify subscription status periodically. If your PayPal subscription is no longer active (cancelled, suspended, or expired), your account will be automatically downgraded to the Free tier.
• Prices are listed in USD. We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Refund Policy

You may request a refund within 7 days of your initial purchase by emailing support@powskill.com. Refunds are not available after the 7-day window, for subscription renewal charges, or in cases of policy abuse. Approved refunds will be issued to your original payment method through PayPal.

6. Lightning Credits, Coins, and Virtual Items

Powskill includes virtual currencies and items:

• Lightning credits are used to access premium features (AI tutoring, AI grading, shared study sessions).
• Coins are earned through gameplay and used in the marketplace for cosmetic items.
• Virtual currencies and items have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred between accounts.
• We reserve the right to modify balances, earning rates, costs, and available items at any time without prior notice.
• Upon account deletion, all virtual currencies and items are permanently lost.

7. Acceptable Use

You agree not to:

• Use Powskill to cheat on official IB assessments or misrepresent AI-generated content as your own work in academic submissions
• Share, sell, or transfer your account credentials to another person
• Upload, post, or share content that is harmful, threatening, abusive, defamatory, obscene, or illegal
• Harass, bully, or intimidate other users through messages, posts, or CAS projects
• Impersonate another person or misrepresent your identity
• Attempt to exploit, hack, reverse-engineer, or disrupt the service, its servers, or its databases
• Use automated tools, bots, or scrapers to access or extract content from the platform
• Circumvent subscription tier restrictions, manipulate credits or coins, or exploit bugs for unfair advantage
• Upload files containing malware, viruses, or other harmful code

Violations may result in content removal, warnings, temporary suspensions, or permanent bans at our sole discretion. Repeated or severe violations will result in immediate account termination.

8. AI-Generated Content

Powskill uses artificial intelligence services — including Google Gemini and Anthropic Claude — to generate lessons, study plans, grading feedback, flashcards, practice questions, and tutoring responses.

• AI-generated content is provided for educational purposes only and may contain errors, inaccuracies, or omissions.
• AI outputs should not be treated as a substitute for official IB resources, mark schemes, or teacher guidance.
• We do not guarantee specific academic outcomes from using AI features.
• When you submit content to AI features (questions, documents, images), it is sent to our AI providers for processing. These providers process data via their APIs and do not use your inputs for model training. See our Privacy Policy for details.

9. Ambassador Program

Powskill offers an Ambassador Program that allows approved users to earn commissions by promoting Powskill and referring new subscribers. Participation is subject to the Ambassador Program Terms & Conditions.

• Ambassador status is granted at our sole discretion and may be revoked at any time.
• Ambassadors earn commission on referred subscriptions based on their tier (Bronze 10%, Silver 12%, Gold 15%, Diamond 18%).
• Payouts are processed via PayPal when the pending balance exceeds $10 USD.
• Fraudulent referrals, spam, fake accounts, or misrepresentation of Powskill will result in immediate termination from the Program and forfeiture of pending commissions.
• Ambassadors are independent promoters, not employees or agents of Powskill.
• Ambassadors are solely responsible for any taxes owed on commissions earned.

10. Referral Program

Any Powskill user may opt into the Referral Program to earn rewards by inviting friends to sign up.

• Upon opting in, you receive a unique referral code (format: REF-XXXX) and shareable link.
• When 15 friends sign up through your referral link, you earn 2 months of free Pro access and 35% off your next subscription payment.
• Friends who sign up through your link receive 15% off their subscription, unless they already have a higher installment discount.
• The 2-month free Pro plan activates automatically and may be cancelled at any time. After the free period, you must subscribe to continue access.
• Self-referrals are prohibited. A user who signed up through someone else's referral link cannot also be counted as a referral for the same person.
• We reserve the right to modify, suspend, or discontinue the Referral Program at any time with notice to participants.
• Fraudulent referrals (fake accounts, bot signups, incentivized signups outside the program) will result in disqualification and forfeiture of rewards.

11. Intellectual Property

Our Content

All content on Powskill — including lessons, user interface design, code, graphics, logos, and branding — is owned by Powskill or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or commercially use any of our content without prior written permission.

Your Content

Content you submit (CAS reflections, blog posts, study notes, messages, feed posts) remains yours. By posting content on Powskill, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content within the platform as necessary to provide the service. You may delete your content at any time.

IB Trademark Notice

"International Baccalaureate" and "IB" are trademarks of the International Baccalaureate Organization. Powskill is not affiliated with, endorsed by, or officially connected to the IBO.

12. User Reporting and Moderation

You can report users or content that violates these terms using in-app reporting tools. We review reports and take action as appropriate, including content removal, warnings, and account suspension. We are not obligated to disclose the outcome of reports to the reporting user.

13. Service Availability

We strive to keep Powskill available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.

14. Limitation of Liability

Powskill is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law:

• We are not liable for any academic outcomes, exam results, or grades.
• We are not liable for data loss, service interruptions, or security breaches beyond our reasonable control.
• We are not liable for the accuracy of AI-generated content.
• We are not liable for interactions between users (messages, posts, CAS collaboration).
• Our total aggregate liability for any claims arising from your use of Powskill is limited to the amount you have paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

15. Indemnification

You agree to indemnify and hold Powskill harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these terms.

16. Dispute Resolution

If you have a dispute with us, we encourage you to first contact us at support@powskill.com so we can attempt to resolve it informally. If we cannot resolve the dispute within 30 days, either party may pursue formal resolution.

These terms are governed by the laws of the Republic of Indonesia. Any legal proceedings shall be brought in the courts of Indonesia, and you consent to the jurisdiction of those courts.

17. Termination

You may delete your account at any time by contacting support@powskill.com. Upon account deletion:

• Your personal data will be deleted in accordance with our Privacy Policy.
• Active subscriptions will be cancelled.
• Virtual currencies and items will be permanently lost.
• Content you posted publicly (feed posts, CAS blogs) may be retained in anonymized form.

We may terminate or suspend your account immediately, without prior notice, if you violate these terms or if we are required to do so by law.

18. Changes to Terms

We may update these terms from time to time. When we make significant changes, we will notify you via email or an in-app notice and update the "Last updated" date at the top. Continued use of Powskill after changes are posted constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the service and delete your account.

19. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
