Welcome to Powskill. These Terms of Service (“Terms”) are a legal agreement between you and [LEGAL ENTITY NAME & TYPE](“Powskill”, “we”, “us”, “our”), the company that operates the Powskill website and app at powskill.com (and currently also at powskill-v5.vercel.app) (the “Service”).
Please read these Terms carefully. They explain what you can expect from us and what we expect from you. If you don’t agree with them, please don’t use Powskill.
Powskill is built for students practising for exams. By creating an account you confirm that the information you give us is accurate and that you meet the age and consent requirements below.
Minimum age. You must be at least 13 years old to create an account. Powskill is not intended for children under 13, and we do not knowingly allow under-13s to register or knowingly collect their personal information. If we learn that an under-13 has created an account, we will close it and delete their information.
If you are 13–15 (or below the age of digital consent in your country). In some countries the law requires a parent or guardian to agree on your behalf before you can use a service like this, or before we can rely on your consent to process your data. Under EU/UK rules this age can be anywhere from 13 to 16 depending on your country. If you are below that age where you live, you may only use Powskill if your parent or legal guardian has reviewed and agreed to these Terms and our Privacy Policy on your behalf. By using Powskill in that situation, you confirm that they have done so.
If you are a parent, guardian, teacher or schoolsetting up or supervising an account for a student, you agree to these Terms on the student’s behalf and are responsible for their use of the Service.
To use most features you’ll create an account using your email and a password, or by signing in with Google. You’ll verify your email through a confirmation link we send you.
You agree to:
Powskill accounts are personal and for one individual. You may not create an account for someone else without authority to do so, or use someone else’s account.
Free plan. Core practice on Powskill is free. This includes practising exam-style questions and full past/predicted papers, writing answers, viewing mark schemes, basic progress insights, and a limited amount of AI marking each day.
Pro plan. A paid “Pro” plan unlocks additional features, which currently include unlimited AI marking, fuller insights, a stronger marking model, and downloads. The exact features of each plan are described on the Service and may change over time as we improve Powskill.
Scholarships. If you can’t afford Pro, you can apply for free Pro access through our scholarship. Details and eligibility are described on the Service. We may approve, decline, pause or end scholarship access at our reasonable discretion.
We may add, change, or remove features, content and plans. If we make a change that significantly reduces a paid feature you’re currently paying for, we’ll handle it fairly (see section 9 on cancellations and refunds).
Powskill is a learning tool. To keep it working well and fairly for everyone, you agree not to:
We may investigate and take action (including the steps in section 13) if we reasonably believe you’ve broken these rules.
When you submit an answer for marking, Powskill uses an automated AI marking system to generate a mark and feedback. This is important:
If you’d prefer your answers not to be processed by automated marking, you can simply not submit them for marking — but note that AI marking is a core part of what Powskill does, so some features won’t work without it. You can also contact us about automated processing (see the Privacy Policy).
You own your answers. The answers and other text you write on Powskill (“Your Content”) belong to you. We don’t claim ownership of them.
The licence you give us. So that we can actually run the Service for you, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process and display Your Content, and to send it to our service providers (including our AI marking provider), for the purpose of operating and providing the Service to you— for example, to mark your answers, show you your history, and calculate your progress and insights.
Improving the Service. We may use aggregated and de-identified information derived from usage (information that does not identify you) to understand how Powskill is used and to improve it, including the quality of marking and feedback.
You’re responsible for Your Content and confirm you have the right to submit it. Please don’t include unnecessary sensitive personal information about yourself or others in your answers (our Privacy Policy explains this further).
Everything that makes up Powskill other than Your Content — including the practice questions, exam-style and predicted papers, mark schemes, model answers, explanations, feedback content, insights, text, design, logos, and the underlying software — is owned by us or our licensors and is protected by intellectual-property laws.
We grant you a limited, personal, non-transferable, non-exclusive, revocable licence to access and use this material for your own personal study only, in line with these Terms. Everything not expressly granted to you is reserved. The acceptable-use rules in section 4 (no scraping, copying, reselling, or sharing) apply.
Names of curricula, exams, qualifications, and organisations (for example the IB Diploma and others) may be trademarks of their owners. We use them only to describe what our practice content is for. Their use does not imply any affiliation with, sponsorship by, or endorsement from those organisations.
This section applies if you subscribe to Pro.
Prices and plans. Pro is currently offered at approximately $9/month, or as an approximately $69 one-off payment(“until your exams”), with a 5-day free trial. Current prices, billing periods, and what each plan includes are shown on the Service at the time you subscribe. Prices may change for the future; we’ll give you notice before a change affects you, and changes won’t affect a period you’ve already paid for.
Payment processing. Payments are handled by our third-party payment processor, Stripe. We don’t store your full card details; the processor does, under its own terms and privacy policy. You agree to those when you pay.
Free trial. If you start a 5-day free trial, you can use the trial features for the trial period. Unless you cancel before the trial ends, your subscription will automatically start and you will be chargedthe applicable price. We’ll make the trial terms clear before you sign up.
Auto-renewal (monthly plan).Monthly Pro renews automatically at the end of each billing period and you’ll be charged the then-current price, until you cancel. The one-off “until your exams” payment does not auto-renew.
Cancelling. You can cancel at any time in your account settings (or via Stripewhere applicable). When you cancel a recurring subscription, you keep Pro until the end of the period you’ve already paid for, and it won’t renew after that. Cancelling stops future charges; it does not by itself trigger a refund of the current period unless a refund is required by law or stated below.
Refunds. Except where the law or our stated refund policy requires otherwise, payments are non-refundable, and partial periods are not refunded.
Failed payments. If a payment fails, we may retry, suspend Pro features, or downgrade you to the free plan until payment succeeds.
Taxes.Prices may exclude taxes; you’re responsible for any taxes that apply to you, unless we state they’re included.
We work hard to keep Powskill running, but we provide it on an “as available” basis. We may carry out maintenance, update features, or change or discontinue parts of the Service. We’re not liable to you for changes, suspensions, or downtime, except as set out in section 12 and as required by law.
To the fullest extent allowed by law:
Some countries don’t allow certain warranties to be excluded. If that’s you, some of the above may not apply, and you may have rights that these Terms can’t take away.
To the fullest extent allowed by law:
Nothing in these Terms limits liability that cannot legally be limited— for example, liability for death or personal injury caused by negligence, for fraud, or, where applicable, your non-excludable consumer rights.
By you. You can stop using Powskill and delete your account at any time in your settings or by contacting us.
By us.We may suspend or terminate your access (in whole or part) if you breach these Terms, misuse the Service, create legal risk for us, or where we reasonably need to — for example to protect the Service or other users. Where it’s reasonable and lawful to do so, we’ll give you notice and a chance to fix the problem first.
Effect. When your access ends, your right to use the Service stops. Sections that by their nature should survive (such as IP, disclaimers, liability, and governing law) continue to apply. What happens to your data after termination is explained in the Privacy Policy.
We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to let you know (for example, by email or an in-app notice) before they take effect. The “Last updated” date at the top shows the current version. If you keep using Powskill after changes take effect, you accept the updated Terms; if you don’t agree, you should stop using the Service and may cancel.
These Terms and any dispute relating to them or the Service are governed by [GOVERNING LAW], and the courts of [GOVERNING LAW & COURTS] will have jurisdiction.
Nothing here removes mandatory consumer protections. If you’re a consumer, you may be entitled to the protections of the mandatory laws of the country where you live, and to bring proceedings there, regardless of the choice above.
