This End User License Agreement ("EULA") is a legal agreement between you ("User", "you") and Powskill ("we", "us", "our") for the use of the Powskill web application accessible at powskill.com, including all associated features, content, and services (collectively, the "Application").
By creating an account or accessing the Application, you agree to be bound by this EULA, our Terms of Service, and our Privacy Policy. If you do not agree, you must not use the Application.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for your personal, non-commercial educational purposes.

The Application, including all source code, design, graphics, user interface, logos, trademarks, lessons, and AI-generated content, is owned by Powskill or its licensors and is protected by copyright, trademark, and other intellectual property laws.
This EULA does not transfer any ownership rights to you. All rights not expressly granted herein are reserved by Powskill.
You retain ownership of content you create and submit through the Application (e.g., CAS reflections, blog posts, feed posts, messages, study notes). By submitting content, you grant Powskill a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content within the Application as necessary to provide the service.
You represent that you have the right to submit any content you upload and that it does not infringe on any third-party rights. You are solely responsible for your content.
The Application uses artificial intelligence services (Google Gemini and Anthropic Claude) to generate educational content including lessons, study plans, practice questions, grading feedback, flashcards, and tutoring responses.
The Application offers subscription plans (Free, Starter, Standard, Unlimited) and virtual items (Lightning Credits, Coins, cosmetic marketplace items). Your use of these features is governed by our Terms of Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at support@powskill.com if you become aware of any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
Your use of the Application must comply with the acceptable use policies set forth in our Terms of Service. Violations may result in suspension or termination of your license and account.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant any specific academic outcomes from using the Application.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POWSKILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF ACADEMIC OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION.
Our total aggregate liability for any claims arising from your use of the Application is limited to the amount you have paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. We may also terminate or suspend your license at any time, with or without cause, with or without notice.
Upon termination, you must cease all use of the Application. Sections 3, 9, 10, 12, and 13 survive termination.
This EULA is governed by the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any legal proceedings arising from this EULA shall be brought in the courts of Indonesia, and you consent to the jurisdiction of those courts.
We may update this EULA from time to time. When we make significant changes, we will notify you via email or an in-app notice and update the "Last updated" date. Continued use of the Application after changes are posted constitutes acceptance of the updated EULA.
This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Powskill regarding the Application and supersedes all prior agreements, representations, and understandings.
